Photographs and photographic negatives were not originally received as part of this collection since they had been subpoenaed by the district attorney's office. In 1992 some of these materials were transferred to the Urban Archives by the district attorney and are listed in a separate inventory. VHS tapes of public hearings are in boxes 28-30. Other videotapes are filed in boxes 67-72.


BACKGROUND

The violent confrontation of May 13, 1985 between the MOVE organization and Philadelphia's city government, which left 11 MOVE members dead and 61 homes destroyed, was one of the most controversial episodes in the city's modern history. In its aftermath, the Philadelphia Special Investigation Commission, appointed by Mayor W. Wilson Goode, investigated in detail the events leading up to and including the attack on MOVE, held televised public hearings, and finally in March 1986 issued a report which was highly critical of government actions.

The confrontation was the culmination of a dozen years of activity on the part of MOVE, which had emerged in the early 1970s as a small and very extreme "back to nature" radical group following the teachings of the self.styled John Africa. Years of increasing trouble with police and neighbors in the Powelton area of West Philadelphia ended in a gun battle in August 1978 in which one policeman was killed and nine MOVE members arrested and eventually sentenced to jail terms. A number of the remaining MOVE members.. all of whom were black.. settled in 1982 and 1983 in a house on the 6200 block of Osage Avenue in the Cobbs Creek area, a predominately middle class black neighborhood. They began to campaign for the release of the comrades and in May 1984 started day and night denunciations of their enemies through a loudspeaker. In October they began the construction of a bunker on the top of their building. The loudspeaker and the extremely unsanitary life.style of the MOVE members led the neighbors to demand action from the newly installed Wilson Goode administration. After over a year of vacillation and appeasement, the city finally determined in the Spring of 1985 on a plan to evict the MOVE members and arrest several of them. But the attack early on May 13 went disastrously wrong, as 10,000 rounds of ammunition, tear gas and explosives failed to break down the heavily fortified MOVE house. At 5:27 pm the Police bomb unit dropped a bomb on the house and the ensuing fire was allowed to spread. When the full damage was assessed the next day, it was found that 11 had died in the MOVE house, of whom five were children, and 250 neighborhood residents were homeless. Only one MOVE member and one child had survived the inferno.

Little more than a week after the bombing, Mayor Goode agreed to the appointment of an independent commission to investigate the MOVE tragedy. The head of the Commission, William Brown III, had been head of the federal Equal Employment Opportunities Commission, and the Commission's eleven members included prominent individuals from a variety of backgrounds, ranging from attorney and politician Charles Bowser and Reverend Paul Washington to former Judge Bruce Kauffman and ex.Watergate Prosecutor Henry Ruth. William Lytton was retained as Staff Director and Temple Law School Dean Carl Singley as Special Counsel. Eventually, the staff grew to include seven investigators, as well as support personnel. Outside experts in explosives, fires and forensic pathology were retained, and eleven attorneys and forty five law students conducted about a thousand interviews in the summer of 1985. The total expense for the PSIC grew to about $1,000,000.

After conducting its interviews and gathering evidence from a wide variety of governmental agencies the Commission held five weeks of televised public hearings in the fall, at which 92 witnesses testified. The members of the Police bomb unit refused to testify, taking the Fifth Amendment after attempts by the Fraternal Order of Police (FOP) to block their appearance failed, and the surviving MOVE member, Ramona Africa, also refused to testify. However, witnesses did include all the key city officials, as well as residents, citizen negotiators and expert consultants. The hearings ended in early November. The Commission then deliberated for several months before issuing its report on March 6, 1986. That report was a sweeping denunciation of the actions of the city government, typified by the finding that "Dropping a bomb on an occupied row house was unconscionable." The PSIC's conclusions about the facts of the MOVE incident were followed by 38 recommendations for specific improvements in relevant city planning and operations. Several of them have been acted upon in the ensuing years.

The records of the work of the PSIC provides a comprehensive account of the MOVE crisis and its antecedents. The Commission staff had the dedication and the funds to organize and index their records with great care. In addition to files organized by relevant city department or other source, the PSIC created computerized lists illustrating the roles and interactions of every policeman, fireman, city official and community resident, computerized grids showing who attended each of the many meetings held before May 13, and indexes to testimony. The thirty cubic feet of records included about six cubic feet of records generated or gathered on its own by the PSIC, including administrative materials, investigative reports and interviews; three cubic feet of testimony at the hearings plus the videotapes of the televised coverage by Channel 12; three cubic feet of clippings related to MOVE; ten cubic feet of evidence submitted by various sources to the Commission; and three boxes containing the live television coverage of May 13, including the full coverage from Channel 10. In addition, most of the key documents are also preserved on 17 reels of microfilm which the PSIC deposited at the Archives.

The heart of the Commission's files are the interviews it conducted and the evidence which was submitted to it, often under the subpoena power granted by the City. Investigators from the PSIC staff interviewed all policemen, firemen, public officials and residents involved in the MOVE events, as well as other relevant individuals such as the FBI liaison to the Police Department and explosives experts. Extensive summaries of all interviews are included in the records. Supporting and related documents submitted by witnesses as part of the interview process are filed with the interviews. These private interviews took place in the summer of 1985 prior to the public hearings in the fall.

 

ORGANIZATION

This collection has been arranged into 7 series:

Series I. Administrative Files. The administrative files include all internal documents generated by the PSIC staff members, including general administrative documents, staff applications, budgets, press releases, notes and correspondence of William B. Lytton, the outlines and drafts of the final report, correspondence with the fire explosive consultants, interviews, and messages.

Series II. MOVE--Background. The background files provides general information about the MOVE operation at the Osage Avenue residence as well as its earlier history. This series includes general information, subjects, interviews with civilian negotiators, a chronological history of events, legal matters, files on Former Police Commissioner Joseph O'Neil and Mayor W. Wilson Goode, and Subpoenas.

Series III. Statement Files. The PSIC defined statement files to include all records consisting, in part, of pre-hearing interviews. This generally includes administrative matters and the interviews themselves from the Police Department, Fire Department, Department of Licenses and Inspections, residents of the Osage Avenue community, Federal Bureau of Investigation, District Attorney's Office and Managing Director's Office.

Series IV. City Agencies. This small series consists of the office files of several city agencies including the Philadelphia Medical Examiner, Streets Department, Water Department, Department of Public Property, Philadelphia Gas Works, Philadelphia Electric Company, City Finance Department, and the City Solicitor's Office. This series also includes a file on the Salvatore Commission.

Series V. Non-City Agencies. Includes the files of the Pennsylvania State Police, the Children's Hospital of Philadelphia, and the Fraternal Order of Police.

Series VI. Public Hearings. The public hearings include administrative matters, security, rules, lists of witnesses, press registers, and correspondence with the media. The major aspect of this series, however, is the detailed depositions of all the key players in the MOVE confrontation. The depositions are arranged in chronological order. The depositions are accompanied by videotapes of the hearings from the WHYY studios. Media Coverage follows the depositions and includes an extensive clipping file from local and national media sources.

Series VII. Evidence. This series is perhaps the most valuable since it contains all evidence presented to the PSIC for its deliberations. The evidence files are arranged alphabetically by the creating departments or individuals.


The PSIC also deposited a database created on Lotus 1-2-3. The database provides ease of access to the followings files:

Evidence -- all physical evidence including video and audio tapes, notes, articles, memos, letters, documents, and photographs. The evidence database provides access to source, type of evidence, content, critical dates, and a "focus code" denoting the major subject matter to which the evidence of document makes reference.
Police -- Listing of all interviews of police personnel, including investigator, location of interview, officer, rank, assignment, assigned weapon, shooter or non-shooter, number of rounds fired, key names cited, and focus codes.
Fire -- Listing of all interviews of fire personnel, including investigator, location of interview, fire fighter, rank, assignment, key names cited, and focus codes.
Public Officials -- Listing of all interviews of public officials and agencies interviewed, including investigator, location of interview, public official, position, assignment, key names cited, and focus codes.
Community -- Listing of all interviews conducted in the Osage Avenue community, including investigator, location of interview, community member, role, address, key names, and focus codes.
Meetings -- Dates, locations, times, and attendance of planning meetings.
Witnesses -- Listing of all witnesses appearing before the PSIC with date and time of their public testimony.
Press -- Listing of all press and media personnel at the public hearings, including affiliation, function, date of birth, place of birth, and social security number.
Index -- Indices coding of PSIC's files.

These photographs were originally part of the files of the Philadelphia Special Investigation Commission. Upon completion of the Commission's work the photographs and some other materials were subpoenaed for the proceedings of the Philadelphia County Investigating Grand Jury of May 15, 1986. The photographs on this list were transferred to the Urban Archives by the District Attorney's Office in 1992.

This collection consists almost entirely of Police Department photography of the Osage Avenue area after the fire. The hyphenated number at the left side of the page is the box number followed by a folder number.
