Biographical Note

Dennis E. Haggerty (1927-2013) was a prominent figure in the disability rights’ movement from the 1960s through the 1980s. As an attorney in Philadelphia, Pennsylvania, Haggerty helped secure individuals’ rights in education, protection, and advocacy through litigation, education, and involvement with numerous local and national advocacy organizations. He worked alongside and in organizations such as the Pennsylvania Association for Retarded Children (PARC and now The ARC of Pennsylvania), the National Center for Law and the Handicapped, and the American Bar Association. Haggerty participated in landmark cases such as the Right to Education Case, serving as Special Master overseeing the implementation of the PARC consent decree, and Halderman et. al. v. Pennhurst State School and Hospital. He also provided his knowledge of the law and intellectual disabilities to numerous organizations such as Research for Better Schools, the President's Committee on Mental Retardation, and the National Advisory Council on the Definition of Developmental Disabilities. The outcomes of Haggerty’s achievements gave people with disabilities freedom from institutions, equal access to education, and equal rights in the community

Dennis Haggerty was born in Philadelphia, Pennsylvania on November 16, 1927. He served two terms in the United States Navy and graduated from Temple Law School in 1955. He began his law career at Novaritis and Haggerty and later at Brisco and Haggerty. Haggerty’s early law career consisted of standard repayment work.

Haggerty married his wife Eileen in 1951 and they had one son and three daughters. It was when Haggerty's son, Dennis (Boomer), became extremely ill at a young age and the illness resulted in an intellectual disability that Haggerty's direction changed. This event made Haggerty realize the vast changes that needed to occur in the rights of the disabled for individuals and their families. It is here Haggerty began to be involved in the Disability Rights’ Movement.  His initial involvement began with the Delaware County Association for Retarded Children (DELARC and now the ARC of Delaware County), which he joined and eventually became the representative to the state of Pennsylvania.

Dennis Haggerty later began as the chair on the Residential Care Committee of the PARC. While on this committee, he investigated Pennhurst State School and Hospital. Prompted by the death of patient John Stark Williams, Haggerty posed as a doctor and went to Pennhurst to with the intent of exposing the conditions there. The investigations helped Haggerty expose the deplorable conditions of the institutions and convinced Haggerty that the only alternative was to close the institution. Haggerty and PARC president Jim Wilson contacted Thomas Gilhool, a respected civil rights attorney who would later become lead counsel for the Public Interest Law Center of Philadelphia. Under the advice of Gilhool, the first battle in the Intellectual Disability Rights Movement was the Right to Education.  Access to schools was seen by Gilhool as the first step toward closing institutions.  This became the Right to Education Case, or the PARC v. The Commonwealth of Pennsylvania. The resulting consent decree, also known as the PARC Consent Decree, opened Pennsylvania’s Schools to children with disabilities. The State was given one year to identify children were not being served or were being underserved. It was this suit where Haggerty acted as a court appointed Master for the State of Pennsylvania. This case was later followed by the Halderman et. al. v. Pennhurst State School and Hospital, where Thomas Gilhool, as lead attorney for the Public Interest Law Center of Philadelphia, represented PARC as a co-plaintiff. The case dragged for fourteen years, and Pennhurst was eventually closed in October 1987.

In Pennsylvania, Haggerty was actively involved in numerous organization including: a board member at Elwyn Institute; a consultant for Research for Better Schools; a board member Developmental Disability Advocacy Network  (DDAN and now the Disability Rights Network of Pennsylvania); a board member of the Education Law Center; an advisory board member of the Delaware County Mental Health and Mental Retardation Board (Delaware Country Mental Health/Intellectual Disability Board); and a board member for the Public Interest Law Center of Philadelphia. In collaboration with these advocacy organizations, Haggerty helped advance the rights of people with disabilities. For instance, as part of the Delaware County Mental Health and Mental Retardation Board, Haggerty aided in the creation of the Mental Health and Mental Retardation Act of 1966, which initiated drug, alcohol, mental illness, and intellectual disability programs.

Involvement in Pennsylvania Disability Rights Movement was only the beginning for Haggerty, who began to work on national and international issues through involvement in numerous organizations including: a board member for the National Center for Law and the Handicapped; a member and chair of various committees for the National Association for Retarded Children (NARC or now The ARC); a member of the National Advisory Council on Developmental Disabilities; and a member of the United States Task Force on the Definition of Development Disabilities. He was a consultant for the President’s Committee on Mental Retardation beginning with President Lyndon B. Johnson to President William J. Clinton. Haggerty was also a member of the American Bar Association, where he began the first committee dealing with intellectual disabilities and the law in the Family Law Section. With this committee, Haggerty conducted workshops at the American Bar Association’s annual conventions. It was here that he also got his start with the National Center for Law and the Handicapped.

In addition to his long-term involvement with many organizations, Haggerty participated in numerous conferences, symposiums, and events both locally and internationally as a speaker and lecturer for the cause of education the public and promoting disability rights. For instance, he was a guest lecturer at the International Convention for Retarded Citizens in Montreal, Canada and he was the Vice Chair of the Symposium on the Legal Rights for the Mentally Retarded in Columbus, Ohio. He also did local lectures in Delaware County, such as a lecture at the Drexel Hill Junior High School in Drexel Hill, Pennsylvania.

Dennis Haggerty’s skills as a lawyer and experience as a parent of a child with an intellectual disability enabled Haggerty to be an asset to the disability rights’ movement in Pennsylvania and throughout the United States. His role as an innovator in disability rights, his drive to educate others, and his vast involvement in organizations working for the movement made him a key player. His participation in the Disability Rights’ Movement helped initiate deinstitutionalization, created equal access to education, and eventually gave people with intellectual disabilities equal opportunities in the community. His advocacy effort continues to effect and inspire the meaningful inclusion of people with intellectual disabilities in the community.

Description of Collection

These records document Dennis Haggerty’s involvement in the Disability Rights’ Movement in Pennsylvania and the United States from the 1960s through the 1980s. Haggerty’s personal records from his involvement with numerous intellectual disability advocacy organizations such as the Pennsylvania Association for Retarded Children (PARC), the Education Law Center, and the National Association for Retarded Children (NARC) document this movement and its history.

The records date from 1950 to 2000, with the bulk of the records dating from 1960 to 1980. The records include agendas, correspondence, brochures, budget materials, conference materials, meeting minutes, memorandums, newspaper clippings, proposals, publications, reference materials, and reports. The record’s strengths include the documentation of the landmark Right to Education Suit (Pennsylvania Association for Retarded Children Consent Decree), the Halderman et. al. v. Pennhurst State School and Hospital case, the activities of the National Center for Law and the Handicapped, and the activities of the President’s Committee on Mental Retardation.

Series 1, Conferences, Presentations, and Events, 1967-1980, undated, contains agendas, attendee packets, correspondence, handwritten notes, informational brochures, meeting minutes, newsletters, newspaper clippings, programs, and travel literature. This series does not have materials for organizations represented in the collection elsewhere unless the event was a gathering of multiple organizations such as the “Southwest and Regional Associations for Retarded Children, Pennsylvania Association for Retarded Children, and President’s Committee on Mental Retardation Conference.” On some files, Haggerty noted whether he attended the event and this information is preserved on a photocopy of the original folder. The series contains events as local to Haggerty as the Drexel Hill Junior High School and events as far as the International Symposium on Collaboration between Parents, Staff, and Clients in Copenhagen, Denmark. Haggerty records include lectures and events at a variety of locations and sometimes for organizations not directly related to disabilities, such as the Lions Club and the University of Delaware. Folders are arranged in alphabetical and then chronological order according to the folder title.

Series 2, Correspondence and Subject Files, 1964-1978, contains correspondence and subject files that did not pertain to any specific organization in the Dennis Haggerty’s papers. The correspondence mostly relates to Haggerty’s business and his involvement in the disability movement. The correspondence is very incomplete. For instance, the folder titled “A” represents a potential alphabetical filing order for correspondence; however, the other files were empty and Haggerty did not appear to have implemented the method. Not necessarily affiliated with his work in the disability movement, the subject files contain Haggerty’s business papers and personal papers. They contain materials such as the papers from the School of the Holy Child and Haggerty’s Alma Mater, Temple Law School. Of interest is the professional information compiled by Haggerty, such as a listing of his affiliations and his resume. Folders are arranged alphabetically by title and then chronologically by date.

Series 3, Professional Affiliations, Pennsylvania, 1957-2000, documents Dennis Haggerty’s involvement in disability rights organizations in Pennsylvania. The series is arranged into seven subseries:

Subseries 3.1, Delaware County Association for Retarded Children, 1974-1984, details Haggerty’s involvement as a board member, president, and council member of the Delaware County Association for Retarded Children (DELARC), known as the ARC of Delaware County (DelARC) in 2012. Established in 1967, DELARC worked to provide support for individuals with intellectual disabilities and their families. DELARC was a contributor in the Right to Education Suit and the Mental Health/Mental Retardation Act of 1966. The subseries contains administrative records, bylaws, booklets, brochures, correspondence, memorandums, newsletters, newspaper clippings, plans, programs, and proposals. Of note in this subseries are the materials related to zoning and DELARC’s move to establish group homes in Delaware County. Subseries 3.2: Delaware Country Mental Health/Mental Retardation Board, 1967-1974, undated, documents Haggerty’s participation on the Delaware County Mental Health/Mental Retardation Board, which as of 2012 was called the Delaware County Mental Health/Intellectual Disability Board. The Board’s responsibility was to establish programs for drugs, mental illness, alcohol, and intellectual disabilities. These responsibilities are documented through agendas, correspondence, minutes, plans, proposals, and reports. The bulk of the subseries is meeting files, which typically contain updates and reports on various services offered for mental health and to intellectual disabilities in Delaware County, Pennsylvania. There are also proposals and information regarding the creation of a group home. Folders are arranged alphabetically by title and then chronologically by date. The records span from 1967 to 1974, but Haggerty’s resume states that he was involved with the board for nine years. These records do not account for the additional two years. Subseries 3.3, Developmental Disabilities Advocacy Network, 1977-1979, undated, contains correspondence, minutes, agendas, and research associated with Dennis Haggerty’s involvement as a board member on the Developmental Disabilities Advocacy Network in Pennsylvania (DDAN). Formed to aid in the execution of the Developmental Disabilities Assistance and Bill of Rights Act in the State of Pennsylvania, Developmental Disabilities Advocacy Network’s goals were to determine the extent of discrimination in Pennsylvania and to be a protection and advocacy agency. As of 2012, Developmental Disabilities Advocacy Network was renamed the Disability Rights Network of Pennsylvania. The records in this subseries consist of Developmental Disabilities Advocacy Network’s early years, where the goal was to analyze the extent of discrimination in Pennsylvania. The papers from April to July of 1977 are incorporation papers. The majority of the materials are advocacy training manuals and Board of Director’s files. Folders are arranged alphabetically by title and then chronologically by date.

Subseries 3.4, Elwyn Institute, 1965-1979, undated documents Dennis Haggerty’s involvement as a board member at the Elwyn Institute for the years 1965 to 1979. The Elwyn Institute began as a live-in residential facility for children and young adults with disabilities in Philadelphia. As of 2012, the Elwyn Institute no longer offered residential services, but it offered program and training services. Haggerty’s interest in the Elwyn Institute was on not only a professional level, but also a personal level because his son Dennis (Boomer) resided at the Elwyn Institute for a period. The series contains administrative records, brochures, correspondence, financial records, meeting minutes, memorandum, and reports. Folders are arranged alphabetically by title then chronologically by date. The bulk of the subseries is the Directors’ meeting and general files. These files contain agendas, articles, brochures, employment information, facilities information, minutes, memorandum, and published materials for Elwyn Institute. Through reports, the records also document the activities several committees at Elwyn Institute. Of interest in this subseries is papers relating to the establishment of the Elwyn-Nevil Center for the Deaf and Hearing Impaired and the conflicting opinions of individuals regarding its creation. There is a material tipped in the folders that appears unrelated to the Elwyn Institute. According to Haggerty’s resume, he was involved at Elwyn Institute until at least 1994, but the records only document his involvement from 1965 to 1979.

Subseries 3.5,  Pennsylvania Association for Retarded Children, 1960-2000, documents Dennis Haggerty’s time as a member, Senior Vice President, Council, Committee Chair, and Board Member of Pennsylvania Association for Retarded Children (PARC). PARC, known in 2012 as the Arc of Pennsylvania, was an advocacy network for individuals with intellectual disabilities and their families. It was instrumental in the investigation and eventual suit against Pennhurst State School and Hospital (Halderman et. al v. Pennhurst State School and Hospital) and the Right to Education Suit (PARC v. Commonwealth of Pennsylvania or the resulting PARC Consent Decree). Dennis Haggerty was involved in the Right to Education Suit through PARC and in his role as a court appointed Master. The Pennsylvania Association for Retarded Children subseries is organized into three sub-subseries in the following order: General files, Pennhurst State School and Hospital, and Right to Education Case.

Sub-subseries 3.5.1, General File, 1962-1999, documents PARC activities not directly related to the Right to Education Case or Pennhurst, although information on these topics may be included in some of the folders. The sub-subseries contains brochures, case files, correspondence, docket sheets, ephemera, fliers, minutes, newsletters, newspaper clippings, and planning files. Folders are arranged alphabetically by title and then chronologically. The majority of this sub-subseries is represented by convention files, correspondence, and general files. The convention materials include agendas, convention publications and brochures, correspondence, minutes, travel brochures, and travel information. The general files are typically a collection of materials printed and distributed by PARC. Some materials were mailed directly to Haggerty in packages and never separated. They include updates, newsletters, fliers, calendars, and correspondence. The case files are of interest because they include Haggerty’s personal investigations and research into various state schools and hospitals. They contain correspondence, handwritten notes, memorandum, and newspaper clippings regarding investigations of facilities such as Polk State School and Hospital and the Mitchell Home.  Although there are significant gaps in the dates, various meeting files for committees such as the Residential Care Committee, Governmental Affairs Committee, Legal Advisory Committee, and the Task Force on Commitment Procedures are represented in this subseries. Sub-subseries 3.5.2, Pennhurst State School and Hospital, 1960-2000, documents the Pennhurst State School and Hospital’s investigation and the resulting court case, Halderman et. al. v. Pennhurst State School and Hospital. Pennhurst State School and Hospital was located in Spring City, Pennsylvania. It was a self-providing, live-in facility with 50 buildings and approximately 2800 residents. Dennis Haggerty investigated the facility while he was Committee Chair of the Residential Care Committee in 1968 and 1969. The sub-subseries contains correspondence, court cases, handwritten notes, newspaper clippings, publications, and reports. Although it is incomplete, of special interest is Haggerty’s story of his personal investigation into Pennhurst State School and Hospital. Haggerty’s story combined with the evaluation of the facilities by the American Association on Mental Disorders and the hearing report of the Special Committee to Investigate State Inspection Institutions under Jurisdiction of the Department of Welfare, offer a glimpse into the Pennhurst State School and Hospital. Also of interest are the conflicting views of parents regarding the closing of Pennhurst reflected in letters and newspaper clippings. There is also interesting ephemera from Pennhurst in the subseries, including an “About Pennhurst” flier and a "Progress and Careers" booklet.  Related materials include investigations of other institutions in the PARC General file sub-subseries and there is information on Pennhurst and institutions throughout the collection.  Folders are arranged alphabetically and then chronologically.  

Sub-subseries 3.5.3, Right to Education (Pennsylvania Association for Retarded Children Consent Decree), 1969-1979, documents Dennis Haggerty’s involvement as a member of Pennsylvania Association for Retarded Children in the Right to Education Case, which resulted in the Pennsylvania Association for Retarded Children Consent Decree in 1971. PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed school-aged children with intellectual disabilities, previously denied public education, to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPET. This subseries includes correspondence, court cases, fliers, memorandum, newsletters, reference materials, and reports. Of interest in the sub-subseries are promotional materials by PARC, including “Childhunt” materials, which document PARC’s effort to find children with disabilities and place them in the public education system. Also of interest in the sub-subseries is Testimony before U.S. Senate Subcommittee on the Handicapped on Senate Bill 6, Education for all Handicapped Children Act, which gives information on some of the outcomes of the Right to Education Case and areas that needed improvement. Subseries 3.6, Public Interest Law Center of Philadelphia, 1975-1984, documents Dennis E. Haggerty’s involvement as a member of the Board of Directors at the Public Interest Law Center of Philadelphia (PILCOP) from 1977 to 1979. PILCOP mission was to provide legal services and legal resources to all populations and it provided Thomas Gilhool as lead counsel in the Right to Education Case. The series contains agendas, correspondence, meeting minutes, newspaper clippings, projects, and reports. This subseries contains the 504 Handbook, which is a handbook that provided training to people with disabilities and organizations according to the Section 504 regulation of the Rehabilitation Act of 1973 of the Department of Health, Education, and Welfare. Of interest in this subseries is the informational booklet with Thomas Gilhool's profile and the information outlining PILCOP’s involvement in the Halderman et. al. v. Pennhurst and the Right to Education Case and the resulting PARC Consent Decree.

Subseries 3.7, Various Pennsylvania affiliations, 1957-1991, contains materials from organizations that did not have enough material to constitute an entire subseries or they are organization for which Haggerty only had limited involvement. The subseries contains correspondence, minutes, newsletters, newspaper clippings, pamphlets, publications and reports. Haggerty was a consultant and part of a review panel for Research for Better Schools, which produced numerous guides for special education resulting from PL 94-142. The Research for Better Schools’ materials contain these guides for teachers, administrators, paraprofessionals, and support staff.  Haggerty was also a member of the Philadelphia Bar Association and a member of the Committee on the Mentally Retarded and the Law. The Philadelphia Bar Association materials contain correspondence, newsletters, newspaper clippings, and minutes. Folders are arranged alphabetically by folder title and then chronologically by date.

Series 4, Professional Affiliations, National, 1962-1988, documents Dennis Haggerty’s involvement in national and non-Pennsylvania organization working with intellectual disabilities. The series is arranged into ten subseries arranged in the following order: American Bar Association (1965, 1967-1980, undated); Developmental Disabilities/Technical Assistance Systems (1973-1978); Education Law Center (1976-1979); National Association for Retarded Children (1963-1979, undated); National Center for Law and the Handicapped (1972-1980, undated); National Advisory Council on Developmental Disabilities (1969-1979, undated); National Task Force on the Definition of Developmental Disabilities (1976-1978); President’s Committee on Mental Retardation (1962, 1967-1980, 1986, undated); and Various National Affiliations (1968-1979, undated).

Subseries 4.1 American Bar Association, 1965-1980, documents Dennis E. Haggerty’s involvement with the American Bar Association and its various committees, sections, and commissions. The subseries is divided into three sub-subseries: Commission on the Mentally Disabled (1979-1979, undated); General Files (1967-1980, undated); and Section on Family Law, (1965, 1970-1980, undated).

Sub-subseries 4.1.1, Commission on the Mentally Disabled, 1975-1979: As of 2012, the Commission on the Mentally Disabled was renamed the Commission on Mental and Physical Disability Law. In the records, the Commission on the Mentally Disabled is largely represented by two large projects, the Developmental Disabilities State Legislative Project and the Bar Funding Program. The Bar Funding Program was a grant-funded program that provided legal services to the developmentally disabled through state and local bar associations. The Developmental Disabilities State Legislative Project was a grant-funded project that created legislative models for states regarding the rights and protection of the developmentally disabled. This sub-subseries contains materials collected by Dennis Haggerty during his time with the Commission on the Mentally Disabled. The materials consist of agendas, correspondence, guides, informational materials, grant applications, memorandum, minutes, newspaper clippings, proposals, publications, reports, and survey. Of interest in this sub-subseries are the Model Acts for States produced by the Developmental Disabilities State Legislative Project. These models are produced in booklets and the topics include zoning, guardianship, and education. Folders are arranged alphabetically by title and then chronologically by date.

Sub-subseries 4.1.2, General files, 1967-1980, contains general American Bar Association materials, such as agendas, correspondence, invitations, journals, minutes, newsletters, and publications. The materials do not necessarily relate to the Intellectual Disabilities Movement. Of interest in this series are the numerous references to the establishment of the Commission on the Mentally Disabled. Also of interest is Dennis Haggerty’s involvement as a presenter at numerous American Bar Association Meetings on various intellectual disability topics.  Folders are arranged alphabetically by title then chronologically by date.

Sub-subseries 4.1.3, Section on Family Law, 1965-1980, documents Dennis Haggerty’s involvement as a chair of the Committee on Mental Retardation and the Law, a section of the American Bar Association created within the Section on Family Law. The Committee on Mental Retardation and the Law was the first of its kind and it goal was to introduce the Disability Rights’ Movement to the legal community. The bulk of the materials relate to an agreement between the Committee on Mental Retardation and the Law and Brandeis University by which Brandeis was studying Massachusetts disability. The folders are arranged alphabetically by title and then chronologically. 

Subseries 4.2, Developmental Disabilities/Technical Assistance Systems, 1973-1978, contains materials from Dennis Haggerty’s involvement with Developmental Disabilities/Technical Assistance Systems. Developmental Disabilities/Technical Assistance Systems operated at the Frank Porter Graham Child Development Center at University of North Carolina. Through a grant from the Rehabilitation Services Administration’s Division of Developmental Disabilities, Developmental Disabilities/Technical Assistance Systems developed administrative tools for intellectual disabilities councils in the United States and its territories. The subseries contains correspondence, newsletters, and numerous publications illustrating the work of the Developmental Disabilities/Technical Assistance Systems. Folders are arranged alphabetically by title.

Subseries 4.3, Education Law Center, 1976-1979, contains materials documenting Dennis Haggerty’s time as a board member for the Education Law Center of Pennsylvania and New Jersey from 1978 to 1979.  The Education Law Center provides legal advocacy to children by ensuring equal access to public education.  This subseries contains agendas, brochures, correspondence, proposals, publications, and reports.  Folders are arranged alphabetically and then chronologically by date. 

Subseries 4.4, National Association for Retarded Children, 1963-1979, documents Dennis Haggerty’s term as a member and a chair of numerous committees for the National Association of Retarded Children (NARC). The National Association for Retarded Children, renamed the ARC in 1992, was a national advocacy organization for individuals with intellectual disabilities and their families. It provided services and support for individuals and advocated for legislation to aid individuals and their families. The subseries consists of correspondence, convention materials and packets, memorandum, minutes, newsletters, and publications. The majority of the records deal with the National Association of Retarded Children annual conventions. These files contain agendas, minutes, reference material, and travel literature and information. Also included are records of committees chaired by Haggerty, which deal issues such as residential care, governmental affairs, guardianship, and research. Folders are arranged alphabetically by title and then chronologically by date.

Subseries 4.5, National Center for Law and the Handicapped, 1972-1980: Founded in 1971 at the University of Notre Dame in South Bend Indiana, The National Center for Law and the Handicapped (NCLH) was a legal advocacy center for individuals with disabilities NCLH sought protection for individuals with disabilities in the areas of medical care, education, and employment and was funded by the Bureau of Education for the Handicapped, Office of Education, the Developmental Disabilities Office, and the United States Department of Health, Education, and Welfare. Dennis Haggerty, with the American Bar Association, was an original supporter and board member for the center. This subseries contains records reflecting Haggerty’s involvement in the NCLH’s establishment and as a board member. The subseries contains brochures, correspondence, court cases, financial records, journals, meeting minutes, memorandum, newsletters, press releases, publications, reference materials, and reports. Folders are arranged alphabetically by title and then chronologically by date.

Subseries 4.6, National Advisory Council on Developmental Disabilities, 1969-1979: the National Advisory Council for Developmental Disabilities was created to provide advice about and study the effectiveness of PL 91-517, the Developmental Disabilities Services and Facilities Construction Amendments of 1970. The council reported to the Secretary of Health, Education, and Welfare. Dennis Haggerty was a member of the National Advisory Council from 1971 to 1975. This subseries documents Haggerty’s service on the National Advisory Council on Developmental Disabilities. The subseries contains correspondence, meeting minutes, memorandum, newsletters, plans, programs, and publications. Folders are arranged alphabetically by title and then chronologically.

Subseries 4.7, National Task Force on the Definition of Developmental Disabilities, 1976-1978, represents records from Dennis Haggerty’s time as a member of the National Task Force on the Definition of Developmental Disabilities. The task force’s responsibility was to define developmental disabilities in order to create more clarity in the Developmental Disabilities Act, but also so that states and organizations had a synonymous meaning of developmental disabilities. This subseries consists primarily of correspondence from numerous organizations and state programs associated with intellectual disabilities.  There are also a number of meeting files including agendas, minutes, and reports. Of interest in this subseries is correspondence with organizations and states regarding the definition of developmental disabilities.  Each organization had a variety of reasons for keeping or creating new specifications to provide inclusion for members or their cause.

Subseries 4.8, President’s Committee on Mental Retardation, 1962-1986 (bulk 1967-1977): The President’s Committee on Mental Retardation, renamed the President’s Committee for People with Intellectual Disabilities in 2003, began with President Lyndon B. Johnson, who formally established the committee in 1966. The goals of the President’s Committee on Mental Retardation were to inform the Secretary of Health and Human Services and the President about topics affecting individuals with intellectual disabilities and the intellectual disability field. Dennis Haggerty served as a consultant for the President’s Committee on Mental Retardation and was active with presidential committees dealing with intellectual disabilities beginning with Lyndon B. Johnson to William J. Clinton.  This subseries documents Dennis Haggerty’s involvement as a consultant with the President’s Committee on Mental Retardation. This subseries contains agendas, brochures, conference materials, correspondence, memorandum, minutes, newspaper clippings, newsletters, publications, travel materials, and reports. The newspaper clippings are from Haggerty, but there are also a number of packets of newspaper clippings created by a newsclipping service for the President’s Committee on Mental Retardation. The publications cover a variety of topics including the history of the Disability Rights’ Movement, the advances in the Disabilities Rights’ Movement, advocacy, transportation, and residential services. There are a number of reports in the subseries, for instance "MR 72: Island of Excellence."  These reports are to the president and discuss various advancements in the disability rights and the areas that need improvement. Folders are arranged alphabetically by title and then chronologically by date. The bulk of the materials date from 1967 to 1980. Haggerty’s resume states that he was involved with the President’s Committee on Mental Retardation until approximately 1994, but these materials are unaccounted for in these records.

Subseries 4.9, Various National Affiliations, 1968-1979, contains materials from national organizations that did not have enough material to constitute an entire subseries or they are organization for which Haggerty only had limited involvement. The subseries contains correspondence, minutes, newsletters, newspaper clippings, pamphlets, publications, and reports. Organizations represented in this subseries include the American Association on Mental Deficiency, Notre Dame Law School and the Council for the Retarded, and the United Cerebral Palsy Associations. Folders are arranged alphabetically by title and the chronologically by date.

Series 5, Right to Education Case, Masters (Pennsylvania Association for Retarded Children Consent Decree), 1969-1974, documents Haggerty’s involvement as a Special Master in the Right to Education Case and the resulting Pennsylvania Association for Retarded Children Consent Decree. Haggerty’s involvement in the Right to Education Suite was with PARC, but he also served as a court appointed Master. In 1972, PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed access all school-aged children denied public education to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPET. The series contains agendas, articles, correspondence, court cases, meeting minutes, plans, reference materials, and reports. Of interest in this series are materials documenting the outcomes of the Right to Education Case, including the programs COMPILE and COMPET and the reports of the task forces assisting with carrying out the agreement. For additional materials on the Right to Education Case, see Series III., Subseries E. Pennsylvania Association for Retarded Children, Sub-subseries 3. Right to Education or Series VI. Topical Reference Files. Folders are arranged alphabetically and then chronologically by date.

Series 6, Topical Reference Files, 1950-1999, includes materials collected by Dennis Haggerty for reference on specific subjects. Haggerty called the files “Reference” and labeled the materials into many categories, but the most prominent categories were “Mental Retardation” and “Legal.”  In order to make the series more usable, it was arranged using narrower subjects or material type. The materials include articles, bibliographies, books, brochures, handwritten notes, journals, newsletters, newspaper clippings, and pamphlets. Some of the materials are duplicated throughout the collection; for instance, a pamphlet printed by PARC about housing may be located in the PARC series and in the Topical reference files under housing. Topics covered in the reference files include advocacy, assistance, commitment, delinquency, education, facilities, guardianship, hearing impairment, housing, law enforcement, programs, rights, sterilization, and workshops. Some of the materials types include court cases, newspaper clippings, and publications. The folders are arranged alphabetically by title and then chronologically by date.

Series 1 contains agendas, attendee packets, correspondence, handwritten notes, informational brochures, meeting minutes, newsletters, newspaper clippings, programs, and travel literature. This series does not have materials for organizations represented in the collection elsewhere unless the event was a gathering of multiple organizations such as the “Southwest and Regional Associations for Retarded Children, Pennsylvania Association for Retarded Children, and President’s Committee on Mental Retardation Conference.” On some files, Haggerty noted whether he attended the event and this information is preserved on a photocopy of the original folder. The series contains events as local to Haggerty as the Drexel Hill Junior High School and events as far as the International Symposium on Collaboration between Parents, Staff, and Clients in Copenhagen, Denmark. Series 2 contains correspondence and subject files that did not pertain to any specific organization in the Dennis Haggerty’s papers. The correspondence mostly relates to Haggerty’s business and his involvement in the disability movement. The correspondence is very incomplete. For instance, the folder titled “A” represents a potential alphabetical filing order for correspondence; however, the other files were empty and Haggerty did not appear to have implemented the method. Not necessarily affiliated with his work in the disability movement, the subject files contain Haggerty’s business papers and personal papers. They contain materials such as the papers from the School of the Holy Child and Haggerty’s Alma Mater, Temple Law School. Subseries 3.1: Delaware County Association for Retarded Children, 1974-1984

 

Subseries 3.1 details Haggerty’s involvement as a board member, president, and council member of the Delaware County Association for Retarded Children (DELARC), known as the ARC of Delaware County (DelARC) in 2012. Established in 1967, DELARC worked to provide support for individuals with intellectual disabilities and their families. DELARC was a contributor in the Right to Education Suit and the Mental Health/Mental Retardation Act of 1966. The subseries contains administrative records, bylaws, booklets, brochures, correspondence, memorandums, newsletters, newspaper clippings, plans, programs, and proposals. Of note in this subseries are the materials related to zoning and DELARC’s move to establish group homes in Delaware County. Subseries 3.2: Delaware Country Mental Health/Mental Retardation Board, 1967-1974

 

Subseries 3.2 documents Haggerty’s participation on the Delaware County Mental Health/Mental Retardation Board, which as of 2012 was called the Delaware County Mental Health/Intellectual Disability Board. The Board’s responsibility was to establish programs for drugs, mental illness, alcohol, and intellectual disabilities. These responsibilities are documented through agendas, correspondence, minutes, plans, proposals, and reports. The bulk of the subseries is meeting files, which typically contain updates and reports on various services offered for mental health and to intellectual disabilities in Delaware County, Pennsylvania. There are also proposals and information regarding the creation of a group home. Folders are arranged alphabetically by title and then chronologically by date. The records span from 1967 to 1974, but Haggerty’s resume states that he was involved with the board for nine years. These records do not account for the additional two years. Subseries 3.3: Developmental Disabilities Advocacy Network, 1977-1979

 

Subseries 3.3 contains correspondence, minutes, agendas, and research associated with Dennis Haggerty’s involvement as a board member on the Developmental Disabilities Advocacy Network in Pennsylvania (DDAN). Formed to aid in the execution of the Developmental Disabilities Assistance and Bill of Rights Act in the State of Pennsylvania, Developmental Disabilities Advocacy Network’s goals were to determine the extent of discrimination in Pennsylvania and to be a protection and advocacy agency. As of 2012, Developmental Disabilities Advocacy Network was renamed the Disability Rights Network of Pennsylvania. The records in this subseries consist of Developmental Disabilities Advocacy Network’s early years, where the goal was to analyze the extent of discrimination in Pennsylvania. The papers from April to July of 1977 are incorporation papers. The majority of the materials are advocacy training manuals and Board of Director’s files. Subseries 3.4 Elwyn Institute, 1965-1979

 

Subseries 3.4 documents Dennis Haggerty’s involvement as a board member at the Elwyn Institute for the years 1965 to 1979. The Elwyn Institute began as a live-in residential facility for children and young adults with disabilities in Philadelphia. As of 2012, the Elwyn Institute no longer offered residential services, but it offered program and training services. Haggerty’s interest in the Elwyn Institute was on not only a professional level, but also a personal level because his son Dennis (Boomer) resided at the Elwyn Institute for a period. The series contains administrative records, brochures, correspondence, financial records, meeting minutes, memorandum, and reports. Folders are arranged alphabetically by title then chronologically by date. The bulk of the subseries is the Directors’ meeting and general files. These files contain agendas, articles, brochures, employment information, facilities information, minutes, memorandum, and published materials for Elwyn Institute. Through reports, the records also document the activities several committees at Elwyn Institute. Of interest in this subseries is papers relating to the establishment of the Elwyn-Nevil Center for the Deaf and Hearing Impaired and the conflicting opinions of individuals regarding its creation. There is a material tipped in the folders that appears unrelated to the Elwyn Institute. According to Haggerty’s resume, he was involved at Elwyn Institute until at least 1994, but the records only document his involvement from 1965 to 1979.

Subseries 3.5: Pennsylvania Association for Retarded Children, 1960-2000

 

Subseries 3.5 documents Dennis Haggerty’s time as a member, Senior Vice President, Council, Committee Chair, and Board Member of Pennsylvania Association for Retarded Children (PARC). PARC, known in 2012 as the Arc of Pennsylvania, was an advocacy network for individuals with intellectual disabilities and their families. It was instrumental in the investigation and eventual suit against Pennhurst State School and Hospital (Halderman et. al v. Pennhurst State School and Hospital) and the Right to Education Suit (PARC v. Commonwealth of Pennsylvania or the resulting PARC Consent Decree). Dennis Haggerty was involved in the Right to Education Suit through PARC and in his role as a court appointed Master. The Pennsylvania Association for Retarded Children subseries is organized into three sub-subseries in the following order: General files, Pennhurst State School and Hospital, and Right to Education Case.

 

Sub-subseries 3.5.1, General File, 1962-1999

 

Subseries 3.5.1 documents PARC activities not directly related to the Right to Education Case or Pennhurst, although information on these topics may be included in some of the folders. The sub-subseries contains brochures, case files, correspondence, docket sheets, ephemera, fliers, minutes, newsletters, newspaper clippings, and planning files. Folders are arranged alphabetically by title and then chronologically. The majority of this sub-subseries is represented by convention files, correspondence, and general files. The convention materials include agendas, convention publications and brochures, correspondence, minutes, travel brochures, and travel information. The general files are typically a collection of materials printed and distributed by PARC. Some materials were mailed directly to Haggerty in packages and never separated. They include updates, newsletters, fliers, calendars, and correspondence. The case files are of interest because they include Haggerty’s personal investigations and research into various state schools and hospitals. They contain correspondence, handwritten notes, memorandum, and newspaper clippings regarding investigations of facilities such as Polk State School and Hospital and the Mitchell Home.  Although there are significant gaps in the dates, various meeting files for committees such as the Residential Care Committee, Governmental Affairs Committee, Legal Advisory Committee, and the Task Force on Commitment Procedures are represented in this subseries. Sub-subseries 3.5.2: Pennhurst State School and Hospital, 1960-2000

 

Sub-subseries 3.5.2 documents the Pennhurst State School and Hospital’s investigation and the resulting court case, Halderman et. al. v. Pennhurst State School and Hospital. Pennhurst State School and Hospital was located in Spring City, Pennsylvania. It was a self-providing, live-in facility with 50 buildings and approximately 2800 residents. Dennis Haggerty investigated the facility while he was Committee Chair of the Residential Care Committee in 1968 and 1969. The sub-subseries contains correspondence, court cases, handwritten notes, newspaper clippings, publications, and reports. Although it is incomplete, of special interest is Haggerty’s story of his personal investigation into Pennhurst State School and Hospital. Haggerty’s story combined with the evaluation of the facilities by the American Association on Mental Disorders and the hearing report of the Special Committee to Investigate State Inspection Institutions under Jurisdiction of the Department of Welfare, offer a glimpse into the Pennhurst State School and Hospital. Also of interest are the conflicting views of parents regarding the closing of Pennhurst reflected in letters and newspaper clippings. There is also interesting ephemera from Pennhurst in the subseries, including an “About Pennhurst” flier and a "Progress and Careers" booklet.  Related materials include investigations of other institutions in the PARC General file sub-subseries and there is information on Pennhurst and institutions throughout the collection.  Folders are arranged alphabetically and then chronologically.

Sub-subseries 3.5.3, Right to Education (Pennsylvania Association for Retarded Children Consent Decree), 1969-1979

 

Sub-subseries 3.5.3 documents Dennis Haggerty’s involvement as a member of Pennsylvania Association for Retarded Children in the Right to Education Case, which resulted in the Pennsylvania Association for Retarded Children Consent Decree in 1971. PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed school-aged children with intellectual disabilities, previously denied public education, to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPET. This subseries includes correspondence, court cases, fliers, memorandum, newsletters, reference materials, and reports. Of interest in the sub-subseries are promotional materials by PARC, including “Childhunt” materials, which document PARC’s effort to find children with disabilities and place them in the public education system. Also of interest in the sub-subseries is Testimony before U.S. Senate Subcommittee on the Handicapped on Senate Bill 6, Education for all Handicapped Children Act, which gives information on some of the outcomes of the Right to Education Case and areas that needed improvement. Subseries 3.6 documents Dennis E. Haggerty’s involvement as a member of the Board of Directors at the Public Interest Law Center of Philadelphia (PILCOP) from 1977 to 1979. PILCOP mission was to provide legal services and legal resources to all populations and it provided Thomas Gilhool as lead counsel in the Right to Education Case. Subseries 3.7 contains materials from organizations that did not have enough material to constitute an entire subseries or they are organization for which Haggerty only had limited involvement. The subseries contains correspondence, minutes, newsletters, newspaper clippings, pamphlets, publications and reports. Haggerty was a consultant and part of a review panel for Research for Better Schools, which produced numerous guides for special education resulting from PL 94-142. The Research for Better Schools’ materials contain these guides for teachers, administrators, paraprofessionals, and support staff.  Haggerty was also a member of the Philadelphia Bar Association and a member of the Committee on the Mentally Retarded and the Law. Sub-subseries 4.1.1: Commission on the Mentally Disabled, 1975-1979

 

As of 2012, the Commission on the Mentally Disabled was renamed the Commission on Mental and Physical Disability Law. In the records, the Commission on the Mentally Disabled is largely represented by two large projects, the Developmental Disabilities State Legislative Project and the Bar Funding Program. The Bar Funding Program was a grant-funded program that provided legal services to the developmentally disabled through state and local bar associations. The Developmental Disabilities State Legislative Project was a grant-funded project that created legislative models for states regarding the rights and protection of the developmentally disabled. This sub-subseries contains materials collected by Dennis Haggerty during his time with the Commission on the Mentally Disabled. The materials consist of agendas, correspondence, guides, informational materials, grant applications, memorandum, minutes, newspaper clippings, proposals, publications, reports, and survey. Of interest in this sub-subseries are the Model Acts for States produced by the Developmental Disabilities State Legislative Project. The Committee on Mental Retardation and the Law was the first of its kind and it goal was to introduce the Disability Rights’ Movement to the legal community. Subseries 4.4 documents Dennis Haggerty’s term as a member and a chair of numerous committees for the National Association of Retarded Children (NARC). The National Association for Retarded Children, renamed the ARC in 1992, was a national advocacy organization for individuals with intellectual disabilities and their families. It provided services and support for individuals and advocated for legislation to aid individuals and their families. The subseries consists of correspondence, convention materials and packets, memorandum, minutes, newsletters, and publications. The majority of the records deal with the National Association of Retarded Children annual conventions. These files contain agendas, minutes, reference material, and travel literature and information. Founded in 1971 at the University of Notre Dame in South Bend Indiana, The National Center for Law and the Handicapped (NCLH) was a legal advocacy center for individuals with disabilities NCLH sought protection for individuals with disabilities in the areas of medical care, education, and employment and was funded by the Bureau of Education for the Handicapped, Office of Education, the Developmental Disabilities Office, and the United States Department of Health, Education, and Welfare. Dennis Haggerty, with the American Bar Association, was an original supporter and board member for the center. This subseries contains records reflecting Haggerty’s involvement in the NCLH’s establishment and as a board member. Subseries 4.6: the National Advisory Council for Developmental Disabilities was created to provide advice about and study the effectiveness of PL 91-517, the Developmental Disabilities Services and Facilities Construction Amendments of 1970. The council reported to the Secretary of Health, Education, and Welfare. Dennis Haggerty was a member of the National Advisory Council from 1971 to 1975. This subseries documents Haggerty’s service on the National Advisory Council on Developmental Disabilities. Subseries 4.7: National Task Force on the Definition of Developmental Disabilities, 1976-1978

 

This subseries represents records from Dennis Haggerty’s time as a member of the National Task Force on the Definition of Developmental Disabilities. The task force’s responsibility was to define developmental disabilities in order to create more clarity in the Developmental Disabilities Act, but also so that states and organizations had a synonymous meaning of developmental disabilities. This subseries consists primarily of correspondence from numerous organizations and state programs associated with intellectual disabilities.  There are also a number of meeting files including agendas, minutes, and reports. Of interest in this subseries is correspondence with organizations and states regarding the definition of developmental disabilities.  Each organization had a variety of reasons for keeping or creating new specifications to provide inclusion for members or their cause.

Subseries 4.8: President’s Committee on Mental Retardation, 1962-1986 (bulk 1967-1977)

 

The President’s Committee on Mental Retardation, renamed the President’s Committee for People with Intellectual Disabilities in 2003, began with President Lyndon B. Johnson, who formally established the committee in 1966. The goals of the President’s Committee on Mental Retardation were to inform the Secretary of Health and Human Services and the President about topics affecting individuals with intellectual disabilities and the intellectual disability field. Dennis Haggerty served as a consultant for the President’s Committee on Mental Retardation and was active with presidential committees dealing with intellectual disabilities beginning with Lyndon B. Johnson to William J. Clinton.  This subseries documents Dennis Haggerty’s involvement as a consultant with the President’s Committee on Mental Retardation. This subseries contains agendas, brochures, conference materials, correspondence, memorandum, minutes, newspaper clippings, newsletters, publications, travel materials, and reports. The newspaper clippings are from Haggerty, but there are also a number of packets of newspaper clippings created by a newsclipping service for the President’s Committee on Mental Retardation. The publications cover a variety of topics including the history of the Disability Rights’ Movement, the advances in the Disabilities Rights’ Movement, advocacy, transportation, and residential services. There are a number of reports in the subseries, for instance "MR 72: Island of Excellence."  These reports are to the president and discuss various advancements in the disability rights and the areas that need improvement. Folders are arranged alphabetically by title and then chronologically by date. The bulk of the materials date from 1967 to 1980. Haggerty’s resume states that he was involved with the President’s Committee on Mental Retardation until approximately 1994, but these materials are unaccounted for in these records.

Series 5: Right to Education Case, Masters (Pennsylvania Association for Retarded Children Consent Decree), 1969-1974

 

This series documents Haggerty’s involvement as a Special Master in the Right to Education Case and the resulting Pennsylvania Association for Retarded Children Consent Decree. Haggerty’s involvement in the Right to Education Suite was with PARC, but he also served as a court appointed Master. In 1972, PARC won the Right to Education Case against the Commonwealth of Pennsylvania, the Secretary of the Department of Education, the State Board of Education, and the Secretary of the Department of Public Welfare. The resulting agreement allowed access all school-aged children denied public education to attend public schools. The agreement also ordered the development of two programs: the Commonwealth Plan for the Identification, Location and Evaluation of Mentally Retarded Children (COMPILE) and Commonwealth Plan for the Education and Training of Mentally Retarded Children (COMPET). COMPILE provided for the creation of 29 local task forces and a state task force to ensure that the Right to Education agreement persevered. PARC and the Pennsylvania Department of Education and Public Welfare jointly organized COMPILE and COMPET.

The series contains agendas, articles, correspondence, court cases, meeting minutes, plans, reference materials, and reports. Of interest in this series are materials documenting the outcomes of the Right to Education Case, including the programs COMPILE and COMPET and the reports of the task forces assisting with carrying out the agreement. This series includes materials collected by Dennis Haggerty for reference on specific subjects. Haggerty called the files “Reference” and labeled the materials into many categories, but the most prominent categories were “Mental Retardation” and “Legal.”  In order to make the series more usable, it was arranged using narrower subjects or material type.
